BMC Air Filter Competition “Game of Skill”
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these conditions of entry.
2. This is a “Game of Skill” with entrants submitting a written entry explaining the reasons why they should win a BMC Air Filter for their vehicle.
3. Entry is open to persons over 18 years of age and Australian residents only. Employees of Link International Pty Ltd, the promoter, and their immediate families are ineligible to enter. Only one entry per person is permitted. All duplicate entries will be removed.
4. Promotion commences on Monday, 15 June, 2009 and closes at 10am on Tuesday 30, June, 2009. Promotion will be via the Link Automotive Website www.linkauto.com.au
5. Entry to this promotion cannot be used in conjunction with any other offer. Judges’ decision is final and no correspondence will be entered into. This is a game of skill and chance plays no part in determining the winner. Entries will be judged on their own originality and creativity.
6. There are 5 prizes to be given away for the duration of the competition. The judging will take place at 11am on Wednesday, 1 July, 2009, at Link International Pty Ltd. at 38 Business Street, Yatala, QLD.
7. To enter: Users must send their details: name, age, phone number, email address and make and model of car they would like to win the air filter, to comps@linkauto.com.au and tell us in 25 words or less, "Why you would like to win a BMC Air Filter?" Incomplete, incomprehensible and illegible entries will be deemed invalid and will not be included in the judging. The Promoter accepts no responsibility for late, lost or misdirected emails.
8. Prize Details are as follows:

Prize value: $109.95 RRP each
9. All above prizes include GST. The total maximum prize pool is $549.75. This prize is not transferable, exchangeable or redeemable for cash or other prizes. Prize value is recommended retail value as provided by the supplier and is correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. There are five prizes in total, with one filter being given to each of the top five responses as decided by the judges.
10. All prize winners will be notified by phone and email using contact details provided in their entry.
11. The promoter may conduct further judging at the same time and place as the original draw as is necessary on, in order to distribute a prize if unclaimed by that date
12. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
13. Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
14. All entries become the property of the Promoter and will be entered into a database. The promoter may use the entrants' names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
15. If for any reason this competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition in accordance with all state and territory regulations.
16. All entries (including but not limited to stories and photos) submitted become the property of the Promoter. Entries (including but not limited to stories and photos) will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoter is entitled to use any entry (including but not limited to both stories and photos) for any purposes at its discretion, including using the entry for future promotional, marketing and publicity purposes.
17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant and/or (f) the redemption of the prize;
18. By entering the competition, the entrant verifies that they have read, understood, and accept these terms and conditions.

Link Auto Club Terms and Conditions:
To be eligible for admission to Link Auto Club™, you must first agree to the terms and conditions listed below, as outlined by Link Auto Club™, Link International Pty Ltd and all associate parties.
You will agree to receive regular email updates from Link Auto Club™, of which outline upcoming specials, events, membership prize draws, news and any other information Link Auto Club™ should deem relevant.
In order to remain eligible for monthly member prizes, you will agree to access your online membership at least one time per 30 days.
Should you wish to withdraw your membership from Link Auto Club™, you may select ‘Unsubscribe’ at the bottom of any of our email correspondence. If you should select this option, your membership will be cancelled and you will no longer receive correspondence from our parties. Should you wish to rejoin Link Auto Club™, you would have to reapply as per the ‘New Membership’ conditions.
